Jim:
Not to be argumentative, but To this date, I have not seen or heard of, nor has any attorney or expert been able to cite a single investigator/engineer being disqualified anywhere in the USA/Canada based upon NFPA 1033. When I asked Stuart this years ago, he could not cite a case either.
Disqualifications based upon NFPA 921...YES.....NFPA 1033 No. If you have already qualified in a jurisdiction, the court generally will accept the qualification again without having to go through a 1033 challenge. I am still waiting for someone to cite one and prove this statement wrong. If you or anyone else know of such, please for the good of the membership here, post the link or case citation.
