            <description><![CDATA[ Oregon House Bill 3746, which became law on July 24, 2025 and became effective on January 1, 2026, operates to shorten the statute of repose for “a tort action by a homeowners association or association of unit owners arising from the defective construction, alteration or repair of a structure or unit.” <br />
<br />
Prior to the enactment of HB 3746, the repose period for such an action was ten years. The new law—specifically Section 1, amending ORS 12.135—shortens that time to seven years following substantial completion or abandonment of construction.]]></description>

            <description><![CDATA[ With the removal of the Cause Classification chapter in NFPA 921, it seems to leave a number of questions as to how to reach a reliable determination of an incendiary fire by following the current contents of NFPA 921. Does anyone have insight based on their experience with the reliable application of NFPA 921 and the Scientific Method?<br />

While there is a definition of an incendiary fire in NFPA 921, there is no discussion of how to arrive at a determination of an incendiary fire using the reliable application of the SM. One needs evidence of intent to start a fire where one was not going to be started, otherwise. There is a huge disconnect between the the Fire Cause chapter (i.e., how the first fuel ignited comes together with the competent ignition source to initiate the fire) and the Incendiary Fire chapter.<br />
<br />
Does the document now implicitly require that in the absence of evidence of an incendiary fire, all fires are initially classified as accidental? That is, the &quot;undetermined&quot; cause classification was removed with the Cause Classification chapter.<br />
<br />
Does only the evidence in the Incendiary chapter allow for a determination of an incendiary fire?]]></description>

Innocent people lost years, even their lives, because those myths went unchallenged. John Lentini has spent his career undoing that damage. In fire investigations, &quot;crazing&quot; refers to a network of fine cracks in glass that was once mistaken as evidence of arson. However, experts now recognize that crazing is caused by the rapid cooling of glass, not rapid heating. Therefore, it is not a reliable indicator of an accelerant and is a well-known myth in arson investigation but not as well known as it should be.<br />

Common myths in fire investigation include associating certain charring patterns like &quot;alligatoring&quot; or V-patterns with accelerant use, believing fire won&#039;t burn downward without &quot;help,&quot; or that gasoline burns hotter than wood, whereas in reality, these patterns are influenced by ventilation and flashover, and fire temperatures depend on fuel and airflow, not just the type of fuel. It’s science, campers. Use it.<br />

The &quot;multiple points of origin&quot; are not necessarily myths but can be misleading or indicative of a natural fire that spread rapidly due to conditions like wind patterns. What was once considered clear evidence of arson, where such a pattern would suggest deliberate multiple ignition points, is now recognized as a potential consequence of fire dynamics, such as flashover. Check your key assumptions at the door, please. Or, hey, maybe use structured analytic techniques, like windows or ACH.<br />

I met John while working at the FBI Laboratory when I became Chair of the Technical (then Scientific…there’s a story, trust me) Working Group on Materials Analysis (SWGMAT) around 1994, one of the precursors to NIST’s OSAC. John was Chair of ASTM E-30 on forensic science* and I was also on that committee. I’d like to think we did some good foundational work back then, getting guidelines and standards out to a hesitant forensic community, much like your parents making you eat your vegetables when you were a toddler; “I know but they’re good for you.” We just did it without making the airplane or choo-choo noise.<br />

And, again, if you’ve ever met John, boy, does he have candor. He’s got all the candor. John’s imposing, one of the few people I know taller than me; if he wants to, the man can loom. He might seem like a big old bear ready to shred you to bits, but, here’s the thing: He will, if you’re being willful, egotistical, or maliciously stupid. If you’re just ignorant, he’ll put the tiny pieces of you back together and help you learn yourself out of your ignorance…after he shreds you. Deep down, John’s a sweetheart, really, a mensch, frighteningly smart, and one of the few heroes I have in this crazy business. A decent human being in a world of venal, selfish dopes. He had a true passion for fire investigation and never hesitated to share it with others. His dedication to this profession was unmatched.<br />

&quot;When pursing your subrogation claims in litigation, your discovery strategy and establishment of the evidence must include rebuttals to asserted affirmative defenses, including, if applicable, a presumptive statute of repose for products. <br />

            Case in point, the United States District Court for the Western District of Washington recently granted summary judgment in favor of Broan-Nutone, LLC (“Broan”), determining that the relevant 12-year presumptive statute of repose for products barred this product claim arising from an allegedly defective ceiling ventilation fan.<br />
<br />
            Allstate Indemnity Company v. Broan Nutone LLC, 2025 WL 691629 (W.D. Wash.) involved a fire that occurred on April 18, 2022, at the home of Charlotte Frankele (“Insured”) in Gig Harbor Washington. Following the fire, the Insured’s carrier (“Carrier”) conducted an origin and cause investigation, determining the fire originated in the laundry room, with fire damage “localized to the ventilation fan and additional fire damage on various items located below the ventilation fan.” Carrier determined the ventilation fan was manufactured by Broan and was installed during construction of the home in 2001. The manufacturing markings on the fan confirmed a date of manufacture in June 2001.&quot;]]></description>

&quot;Within a day of the fire, Encompass retained counsel, who retained a team of expert investigators to inspect the scene. ... The investigators inspected the fire scene multiple times in January and February 2021. .... According to their report, their on-site “[e]xamination… revealed the origin of the fire to be at the passenger side mid-section of the [RV].”  They explained: “The fire scene examination further disclosed that within the area of origin within close proximity to each other, were the dehumidifier, oil radiant heater and the motorcoach refrigerator, which were all collected for further forensic evaluation. At the time of the site examination, we could not rule out any of the three items due to the extensive fire damage.” <br />
<br />
Meanwhile, the Snohomish County Fire Marshal also investigated the fire scene, beginning on the day of the fire. ... In April 2021, the Fire Marshal issued a final report, including 395 photographs of the fire scene. ... Like Encompass’s experts, the Fire Marshal concluded that the fire “start[ed] near the center of the [garage] structure, in [the RV].” ... The report stated: “While the exact cause of the fire is undetermined, three possible causes that cannot be rule[d] out are [1] high resistance heating/arcing within an energized and operating dehumidifier, [2] portable electric oil filled radiant heater, or [3] a failure with the electric refrigerator/freezer inside the motorhome.” ....<br />

On March 9, 2021, the insureds submitted an estimate to Encompass for the demolition of the burnt-out garage building. ... Encompass approved the estimate,..., and by April 6, the demolition was complete. ... Norcold did not get a chance to inspect the fire scene before the demolition, as Encompass only notified Norcold of the fire on June 23, 2021—nearly five months after the fact. ...&quot;<br />
