So Federal Rule 26 requires that an expert produce among other things, "(v) a list of all other cases in which, during the previous 4 years, the witness testified as an expert at trial or by deposition;"
I have no problem providing such a list, but now I am getting requests (via subpoena duces tecum) to produce the actual transcripts of the depositions. I don't keep them for closed cases, but I obviously have to keep them for cases that are not yet resolved.
Does anyone else see a problem with such a request?
