An associate of mine is involved with this case. Should be very interesting to see how this plays out.
Obviously Hipaa is the first thing that comes to mind, but when you consider that a police officer can obtain a warrant to draw your blood to test for BAC I think the defenses argument will be nullified. Obviously I'm not a lawyer, nor pretend to have any legal insight.
Definitely precedent setting either way it washes out.
