Not according to NFPA 921. If you cannot prove it intentional, according to the committee, you still have to prove an accidental cause, or else you must call it undetermined.

The committee has rejected the proposition on several occasions that a fire should be presumed to be accidental until proven otherwise, despite the fact that such is the LAW in a number of states.
