ok, so two years ago swim (someone who isnt me) caused a fire in the restroom of a public school building. Swim was smoking in the restroom and put out a cigar before tossing the cigar into a nearby trashcan. Which caught fire about 10 minutes later. Fastforward 2 years later and swim is facing a first degree arson charge. The only thing the prosecution has is video footage of swim leaving the restroom 10 minutes prior to the fire. They "claim" that you can partially see smoke trailing swim out of the restroom, and that the fire was in the sink as well as the trashcan. It was accidental, no accelerants of any kind were found, and no intent whatsoever. No hard evidence besides the fact that swim was the last one there and admitted to smoking. Does anyone think there is enough evidence here to get swim convicted of a 1st degree arson charge? Also, it was after normal hours of use, therefore would it still be considered a 1st degree charge?? Thanks for any advice or help.
