In most instances, first degree arson must involved a building is is "occupied" or reasonably believed to be occupied by someone other than the actor. In other states, first degree involved any "occupied" building (that is being used for some purpose), even if no one is in the building at the time of the incident.
Really need to know the specific language used in the particular state's arson statues.
