Are there not two matters here, Criminal & Civil.
The Criminal Courts say that the cause must be determined as being, "Beyond A Reasonable Doubt". On the other hand the Civil Courts say that if the cause that is determined is correct "On A Balance Of Probabilities" it can be determined as the reasonably correct cause. Those are the findings of the Canadian Courts.
It is my understanding that the U.S Criminal Courts take the same position but the U.S. Civil Courts say the cause is determined on assessing the "Preponderance Of The Evidence".
