First of all it has been a long time since an attorney beat me up. second of all, and I am sure you know this, how the witness states his thoughts determines how much you have to beat them up. Third is I believe most attorneys use the following process. “When the law is against you, argue the facts. When the facts are against you, argue the law. When both are against you, attack the oposing expert… When the oposing expert is right… attack his creditability by arguing he didn’t have save his notes so he is this big villain out to get your client. Muddy the water, blow smoke and use all the mirrors available to confuse the jury so they will forget the facts.
