The mutual understanding of the difference in meaning and use of such terminology needs to be understood before any meaningful conversation can be had.

A reasonable question ...I do not have an objective answer for you.

In thinking about it more, the practical solution is to recognize there is a difference, make it understood to those involved in the discussion that there is a difference, and make it known what the difference is. For example, in cross, if the lawyer characterizes your determination as "just a theory," an effective response would be to explain the SM in the context of hypotheses, theories, and laws. Tell the jury that his/her characterization of his determination is misleading and false.
