Dave, I was talking about having all the pieces and not being able to use them because of how they were obtained. This could happen to private or public. If you use them you may violate your personal integrity and the law and give the serious criminal a pass because you violated the law; illegal s&s for example. If you don't use the facts, even though ill-gotten, you could allow a serious criminal a pass (which he may get anyway as noted in the previous sentence). This is why we have the Constition; better to let beacoup guilty men go free than allow an innocent man go to jail as much as it may gall us.
