Oregon State Police & other local jurisdictions have been arresting and prosecuting individuals making and using these even back when I was in college in the late 80's. I recall several fraternity boys were in trouble when they started with these devices and then graduated to a black-powder pipe bomb and used it on a rival fraternity glass window. Fortunately they missed killing some students in the fraternity, but all involved were arrested and convicted.
