At least in Illinois the answer is "It depends" Illinois is not a mini/max state. The local AHJ enforces the codes they want to by municipal code adoption. The State of Illinois does enforce the 2000 NFPA Life Safety Code and only portions of the ICC codes.
Most municipalities enforce the ICC codes. By code the builder/ designer shall design their building to the codes adopted by the local AHJ.
There is a significant loss of "points" when it comes to ISO and other accreditation agencies if you have not adopted the most recent codes or at least the codes from the last code cycle. Should a municipality adopt the latest codes? In my opinion yes, along with the associated NFPA codes and the ANNEX to the NFPA codes.
Now lets take it one step farther. Hypothetically and only hypothetically my make believe municipality does not adopt the NFPA codes or they only adopt the NFPA codes that are refereed to in the ICC. Does that mean during a fire investigation 921 and 1033 are moot? You may have a government body that only wants to adopt the ICC codes and not even look at the NFPA codes.
