"Enforcement" and "Liability" are two separate issues, addressed by two separate groups, with different goals.
Enforcement addresses whether something meets a code or standard before the fact, regardless of whether there's a loss or not. Liability doesn't come into play until there is an actual loss after the fact. (That's why you see a distinction between Underwriting and Claims art insurance companies,)
In other words, while codes address what might happen; liability address what did happen. The previous answers are correct.
