A fascinating read... several comments...
Ms. Bunch is VERY lucky (I know, that sounds like such a misnomor after being wrongfully imprisoned...)
One of the criticisms made in wrongful arson convictions is that a chief problem is ineffective counsel. Let us pretend that the CO analsyis did not get into evidence not based on an availability issue, but because counsel was incompetent. Ms. Bunch would have lost this appeal.
Secondly, the buffoonery exhibited by the State's investigator is sad. Circular logic...
Q. How did you determine that it did not start in the ceiling?
A. [no answer]
Q. Because it started somewhere else?
A. Right[,] because the indications were that the fires did not originated [sic] in the ceiling. They originated on the floor.
Trial Record at 877-78. Frank‟s testimony indicates because he believed the fire started on the floor, it therefore did not start in the ceiling. He did not testify to any other reasons for coming to the conclusion the fire did not start in the ceiling.
