I agree with you but from what I have seen the PI Boards have been granted the right to have cease and desist order issued for persons operating without the proper licenses. Where you are right the court has the final decision as to if you are to be qualified as an expert, but it seems the courts have conceded to the legislature the right to say who can work within a jurisdiction.

The right to be considered an expert by a court and the right to work within a jurisdiction are completely different areas of the law and can not be considered as one.
