This is a decades old issue and I have asked everyone Doug. This forum has 762 postings involving the topic of 1033 going back to 9/5/2006 (14 years ago). Oh there are anecdotes and innuendos (someone heard of someone) but not a single court citation (judgement, ruling, etc) has ever been able to be produced showing a disqualification of any expert based upon 1033.
I am serious here... for the good of everyone... ANYONE....please cite ANY such documentation. If it exists, it should be a matter of public record and maybe not cite the decision/ruling/reasoning, but the court case identifier at least is fair game.
