I have a fire where the public fire investigator determined the origin solely on the amount of damage and the location as to where the fire started was based on a “V” pattern. Because this investigator was falling short on the ability to support this contention the prosecutor brought in a retired federal agent. This person issued a report and later testified that the public investigator’s investigation met all the requirements of 921.
The use of heaviest area of damage and “V” patterns not being reliable is not being taught strongly enough in the classes I have attended. They do not go over the limitation as to what data obtained from these indicators may be accurate and what may not be accruate.
