I just believe the reader of the post should have facts. Over the years additional facts have come to light. I know you are not saying these facts should not be brought to light.

I do not know where you get the idea that I disagree with NAFI’s position. I believe any organization has the right to develop it own benchmark to use when measuring the standard of care being given by its members. By the way, I am a life member of NAFI. Their use of 921 as the standard for their training has been a plus for the fire investigation profession. All I was pointing out was that NAFI is the only organization that has taken a definite position on 921.

I know ATF and other organizations have their own certification programs. All I was trying to point out is that the organization the is responsible for the development and publishing of the document, as well as the ownership pf the information contained in the document does not offer a certification based on the document being a standard of care for fire investigators.

Based on you information about California certification I decided to look it up. Are you talking about the CCAI certification program? I agree that they use NFPA 921 as a part of their training program. What I could not find is them stating they have adopted 921 as the standard of care for their organization. Not saying they have not, but just I could not find it.

I am not arguing that the courts have not used and are not continuing to use 921 as a benchmark when evaluating the investigation conducted by individuals. All I am stating is that I cannot find a court that has declared in their opinion that 921 is the standard of care for fire investigators. It may be out there, but I just have not found it.

I have done what you suggested and looked at each of the cases posted. In none of those case was 921 used passed being a benchmark. None of the courts stated that NFPA 921 is the standard of care for fire investigators. What the courts did do is use it to a different degree to assess the investigation conducted. Most addressed the methodology used by the person.

You may disagree with the suggested wording for the scope of the documents, that is your right. I do not even say you are wrong for feeling that way. All I was trying to point out is that it appears that NFPA is trying to clarify the use of their document. Who should know more about their intent for the document than NFPA? That is all I am trying to say.
