I did not want to mislead any reader but were the court did not state NFPA 921 was not the Standard of Care, the court did say failure to strictly follow NFPA guidelines is not warranted under the circumstances. It is not readily apparent that a failure to strictly adhere to all NFPA guidelines renders an investigation incomplete or unreliable. In addition, while these guidelines provide a legitimate criteria for evaluating an investigation, there is nothing before the Court to suggest they are exhaustive or exclusive.
I think you would agree, where they do not use the exact words, it is fairly evident as to what they are saying considering they did not feel 921 was exhaustive or exclusive.
