I think the answer to your question is really nothing new. I would want to know if the expert used a reliable methodology to reach his/her opinions. While this may seem like a general test, there are many elements are are frequently not addressed by the gatekeeping process. Assuming that the methodology was the scientific method, I would want to know if the expert tested his/her hypothesis against ALL of the available data? For example, can the hypohtesis explain the victims uptake of products of combustion and explain how they died in a fatal fire? The use of blood toxicity data is frequently ignored with respect to the analysis of the fire. An additional missing element of the testing of hypotheses (in my experience) has been testing the hypothesis against the available scientific literature.
