If the plaintiff sends Notices of Intent to Subrogate, that has been identified by counsel as a CLAIM. The basis of the justification for going after recouping costs is that filing a false claim will incur expenses that normally would not have been incurred if the plaintiff's experts had not been negligent in the identification of potential parties.

This to my knowledge HAS NEVER been an issue with a Notice of Intent to Inspect. You are not blaming the opposing party (justified or wrongly), just informing them of your intent to proceed forward.
