I agree with having levels of confidence for one’s opinion, but believe if your opinion will directly affect another person anything below certain is not acceptable. I agree in civil cases the burden of proof is a preponderance of the evidence. I agree with what you say that this is the same as probable and is good for stats but not for affecting a person’s life in a civil or criminal proceeding. If you do not know for certain what cause the fire then your determination is based on subjective are speculative reasoning based on the known facts. If 921 states that subjective or speculative can not be included in the analysis of data collected to form a hypothesis, how then can there be any justification to using a subjective or speculative methodology for reaching a conclusion as to the cause?
