This addresses a different "probable cause" than we have been discussing, "probable cause" for a search warrant or "probable cause" to believe that a crime has been or is being committed (exigent circumstances, etc.). It has nothing to do with the legal definition of "more probable than not," which is and always has been looked upon by the courts as “more than 50% likely to be true” or a preponderance of the evidence.
