In the private sector it is not unusual, inappropriate, at all unethical to not write a report if the client does not want one. If your opinions do not please the client, it is entirely the client's call on whether a report is to be written (and charged for).
In the states where I am licensed it is unethical and frequently unlawful to disclose information without the consent of the client. This is especially true if the client is an attorney. Until a private sector investigator, hired directly by an attorney, is offically disclosed by that lawyer as a potentional testifying expert, the investigator's work is "attorney work product" and protected by attorney-client privilige.
