To me, it seems that removing any reference to human intent in NFPA 921 just pushes a subsequent investigation, as to intent, down the road with an assumption that it can either be done better by others or that there is other evidence that can be used to determine a crime has been committed. If this is the case, then whom is to conduct this subsequent investigation? What is the reliable methodology used to render reliable determinations? What evidence is used or required to reach a reliable determination?
It is hard not to think that perhaps we are not progressing forward, but regressing backwards in the pursuit of reliable determinations. Will it be the "ipsi dixit" of someone other than the fire investigator doing an investigation under NFPA 921?
