We can go over this over and over. My opinion is that all data is evidence. Show me a peer reviewed document that states it is not.
Yes, the for-sale sign is evidence. It is evidence of motive. Show me a court opinion where it says it is not. It is as relevant as can be to show motive. I am not saying it has anything to do with the cause of the fire.
Again, show me a peer reviewed document or a court finding that states the process of elimination is restricted. Also, give me a published document as to what is a open system and the scientific method is considered to be an open system.
If the investigator does not know if he has all the available evidence, he should state that the opinion is limited to what evidence was used to reach a conclusion.
An opinion is the result of the gathering of information, analyzing that data, the development and testing of a hypothesis. The results of each of these steps directly relates to the person conducting these activities. In no way does it prove that no other conclusion cannot be reached by a different person using the same information.
Show me a peer reviewed document or a court finding that states the process of elimination is not a reliable methodology to be used as part of the scientific method. Yes, that is your personal opinion, and I accept that is you opinion. It does not make it mandatory for everyone else in the profession. The elimination process is still used throughout the text of 921.
