I am not sure I could disagree with you. I believe person on a jury that are not everyday involved with out terminology could get confused. My post was based on the wording of 921 and not my feelings on the subject.
I am not sure the determination of the origin and the determination of the cause should not have the same level of certainty. Here, as Pat said, we are not looking at the cause but the classification. The same level of certainty is used for both the cause and the classification. I hate to send a person to jail if the evidence as to the cause and the responsibility is not at the level of conclusive.
