His intent was to use the matches for lighting not arson. So you have a burglary followed by an accidental fire. This has kind of come up in the meth lab situation in our state. If your house blows while cooking you had manufacturing methamphetamine if you could find enough evidence in the debris to support that but an accidental fire. We now have passed an addition to the arson statute that covers this and if you burn your house down while cooking you get charged with arson as well.
