We had a fair amount of success with charging the person with Felony B&E and then adding Misd Damage to Property for those fires where a fire occurred as the suspect used a lit piece of paper to illuminate what he wanted to steal or the fire occurred as a result of a cooking or warming fire after an illegal entry. You do not have to prove any intent as to the cause of the fire. The suspects were in the building illegally, started a fire, and damaged someone else's property.
