Let’s try another scenario. There is a fire in the middle of a building. The building is 24 feet by 24 feet. The business is a lounge. There are no windows in the building and only two doors. When the business is closed both doors are pad locked. The only key for the pad lock is in the owner’s position. The fire department arrives on the scene finding smoke coming from the building and the doors locked. The fire department forces entry into the building and extinguishes the fire. Because of the strong odor of gasoline in the building and investigator is called. The fire is determined to have been intentionally. Would this be sufficient evidence for you to arrest the owner?
