I believe theoretically all information should be retained forever, however the practically of the subject tells us this is not possible. What reason would be there to keep field notes, diagrams, or other raw documents if you have no anticipation of litigation? What is your definition of potential litigation? Are you indicating that an investigator freely turn over his investigation file without going through the legal process? Just because one side ask for document does not mean they are entitled to that information.
