I see absolutely no difference between a public guy destroying evidence and a private guy destroying evidence.
If there is "bad" stuff in your notes, it's only because you put it there. If a "clever" expert finds something to ask you about, all that is happening is the "careful and serious challenge" described in NFPA 921, or the "right to confront the evidence" described in Amendment 6. It's the worst justice system ever designed, except for every other system ever designed.
And yes, private guys are frequently served with a subpoenae to turn over the entire file including notes diagrams etc etc.
