Jim,
The question is why the judge did not allow the production of the FBI agent's notes. Was it because he held that the transcription of the information in the notes was accurate, or possibly because there were other sensitive issues in the notes which he held were not germane to the issues?
Our discussion here is about notes being destroyed and therefore not available to the other side of a litigation. This does not appear to be the issue in the case which you cite.
