This I have not problem with in that the investigator should have a working knowledge of the laws governing evidence preservation and how it relates to spoliation. The courts have ruled that there is no relationship between the preservation of field notes and the spoliation of evidence. If and when there are changes, due to rulings from the court, then it is the responsibility of the investigator to make the necessary changes in his or her procedure.
Now the answer to my question as to why not use 1033 as the standard?
