I keep my notes in the file - my need to review them in the future is just as important to me as someone else's desire to look at them. During prior depositions, I have been asked to produce the notes during some of those depositions, but not by all attorneys. I do think that there is less risk with keeping your notes than there is benefit in destroying them. I do not think we will find one policy that will "mesh" with all court rulings. We all know that trial judges (state and federal) are independent-minded individuals and not all appellate courts see the same issues alike. Like discussions on other topics (opinions, for one), it is going to be hard to find the middle ground to satisfy criminal v. civil, state v. federal, Rules of Evidence (state and federal), etc.
