Nice that you posted an actual case. I have yet to see anyone on the other side of this argument site a REAL case that explicitly says notes are evidence and destroying them if that is your practice is a crime. Interpretations of what is in 921 are not case law. Again, I keep mine and have for the last ten years or so. They have not created a problem for me as of yet. Who knows one day they may. What I do understand, and so do the naysayers, is where the practice started and why it started years and years ago. Should the practice be changed? Maybe. It won’t however get done on this board. The courts will eventually change it if they see fit. I do think sweeping statements of destruction of evidence and throwing around words such as “Crime” is really uncalled for and doesn’t really apply here in the legal sense of the word. It may be some folks opinion that that is what is occurring but that doesn’t mean its so legally or ethically.
