Where I do not disagree with your reasoning, as I said I just do not have a problem either way. I think you, Pat and others brought up some excellent points to be considered, but as I said, I believe this is a personal decision to be made by the individual. If he tells me that all of what notes were taken are in the report, I will give him the benefit of the doubt that it is all there. I can understand with some of the cases you have been involved with that the trusting does become an issue, and maybe with the same factors I to would be a little short on trust.
I agree with you as to the legal issue and feel the attorneys will continue to argue this point to where one side has the upper hand over the other. In reviewing case and policies of different organizations it does not appear this has yet become a problem in court. In one of the may cases I was looking at the judge instructed the opposing attorney that the only question that could be asked is was there original notes taken and what happen to the notes. At that point the judge instructed the jury that this is not an uncommon method and there should be not thought that the person did something wrong by using this method.
As I said before this is a personal issue to where the person must look at all the possibilities that will result as to his actions and then make a decision as to how this is to be handled.
